Client Charged with Possession of Over 100 Kilos of Ketamine has Charges Stayed After Successful 11(b) Application

On December 5th, 2017, Morgan Ross was successful in an 11(b) application for delay before the Ontario Court of Justice at Old City Hall. The accused, J.S., was alleged to have possessed 100 kilograms of Ketamine and proceeds in excess of $5,000.00 after Toronto Police execute a search warrant at the apartment of J.S. in May, 2016. All charges against J.S. were stayed as a result of unreasonable delay in having the matter proceed throughout the Court as required in R. v. Jordan. The total delay was calculated at 19 months, 22 days – 1 month and 22 days about the presumptive ceiling. J.S. faced a 6-8 year penitentiary sentence if convicted for Possession for the Purpose of Trafficking and Possession of Proceeds.
